The City of Wayzata has prevailed in a legal dispute with Lake West Development LLC over redevelopment plans for the former TCF Bank property at 200 Lake Street East.
In an order filed October 30, Hennepin County District Court Judge Joseph R. Klein granted summary judgment in favor of the City on all counts, ruling that Wayzata complied with Minnesota’s 60-day rule for land-use decisions and acted lawfully in conditioning approval of Lake West’s three-story Planned Unit Development application. The court also denied Lake West’s request for a writ of mandamus that sought automatic approval of its separate four-story proposal.
The decision effectively upholds the City Council’s handling of both redevelopment applications and the requirement for a new PUD agreement to replace the 1989 plan governing the site.
It remains to be seen whether Lake West will appeal the ruling to the Minnesota Court of Appeals.
