WAYZATA — The City of Wayzata has been formally served in a forthcoming lawsuit related to the Lakewest development at 200 East Lake Street, Mayor Andrew Mullin confirmed Thursday.
“The City was just served,” Mullin told Wayzata.com late Thursday afternoon via a telephone call. Mullin said he hadn’t seen it personally but was informed by City staff.
Deputy City Manager Aurora Yager also confirmed the service.
Wednesday evening, Mullin had indicated the developer was evaluating legal options. “Their official position as communicated to me by Curt Fretham is that the approval—with five massing breaks as defined—makes the project challenging, and they are evaluating all options including litigation,” he said. “But no formal legal process has occurred, so it may or may not occur.”
That formal process now appears to be underway.
The Lakewest project, proposed for the former TCF Bank headquarters site, was approved by the City Council in 2025 with conditions including five massing breaks to reduce visual impact along Wayzata’s signature lakefront.
Asked for comment Wednesday night and again Thursday afternoon, developer Curt Fretham did not respond immediately.
City officials have not yet commented on the contents of the legal filing or potential implications for the project timeline.
In civil proceedings, formal service typically precedes the filing of a complaint, notifying the defendant that legal action is imminent before the lawsuit officially enters the court system.
